The Fashionation.me website (the "Website") is provided by The Collection FZ LLC ("we", “us”, “our”) for your and others' personal, non-commercial enjoyment. Fashionation.me is a specialist online retailer offering products including designer clothing and accessories, beauty, home ware, travel ware and entertainment products at discounted prices to registered members.

Your use of the Website is subject to these terms and conditions and we kindly request you read these terms and conditions carefully. If you do not to accept these Terms and Conditions, we kindly ask you to discontinue the use of our Website. Your continued use of the Website shall constitute your agreement to these terms and conditions, these terms and conditions must be read in conjunction with our Privacy Policy.

From time to time, we may amend these Terms and Conditions. These amendments may arise from changes in the law, best practice or changes in our services. Any changes to these Terms and Conditions will appear on the Website and we kindly ask you to regularly revisit our Website to review them. If you do not agree to the amendments, you will not be able to purchase any item on the site. By using this site after we post any changes, you hereby agree to accept those changes.

Registration & Eligibility:

You may visit our site at any time, however you will need to register to be a member and log in to access and use most areas of our Website. To be eligible for membership you must be at least 21 years of age or have your parents or guardians consent.

In order to purchase on our Website, we will ask you to provide some details, such as your name, contact numbers, address and interests so we can get to know you. We use the details you provide to contact you and provide our services to you so it is important that the information you provide is true, accurate and complete. If any of your information, such as your address or telephone numbers, changes, you must update your account details on the Website by accessing your profile. All personal information collected will be used, disclosed or otherwise processed by us in accordance with our Privacy Policy.

Membership is free. There are three different levels of access and membership and some special conditions apply before you can reach particular membership levels.

A “One month visitor visa” is a temporary access pass of thirty (30) days and can be obtained by completing the registration form available here Request Membership.

“Permanent resident” status is automatically granted to you after you make your first purchase. Becoming a permanent resident provides you with a membership that is valid for 12 months from the date of your purchase. Each time you make a purchase, your permanent residence will be extended and will remain valid for 12 months from the date of your last purchase. At the end of the 12 month period, your permanent residence will expire.

Becoming a ,“Citizen” provides you with lifetime membership and is granted to permanent residents after you have made 12 valid transactions on the Website or saved the equivalent of US$ 5,000 (calculated using the recommended retail prices detailed on our website) in a consecutive 12 months period. Citizens can also benefit from additional advantages or benefits which may be notified to them from time to time.

If you are referred to the Website by an existing and current Permanent Resident or Citizen and you are a new member, you will automatically be granted a membership status of Permanent Resident. If no transaction for 12 months, it expires automatically.

You will need to provide us with a member name and password before you can enter the site and order items from us. Your member name and password are personal to you and are not transferable. Any breach or suspected breach of security of a members name and password must be notified to us immediately. You will be responsible for any payments due for items ordered through the Website by anyone using your member’s name and password. You are responsible for the use of your password and maintaining its confidentiality.

In the event of a forgotten password you can obtain a new one by clicking on the link 'Forgotten your password?'. A new password will be sent to you, to the e-mail address provided by you. You will also have the ability to change this password under ‘My Account’.

Inviting a Friend

We want you to be able to invite your friends to share in the specials and discounts we offer. If you refer a friend and they successfully and validly complete the membership requirements and make a purchase on our Website (“Valid Referral”), you will and your friend will receive a Discount Voucher at the time your friend places their first order and their order is shipped out for delivery (“Invitation Voucher”). The value of our Discount Vouchers may change from time to time depending on the nature of our promotions. Your Invitation Voucher will be valid for one (1) year from the date that the Invitation Voucher is sent to you. Vouchers not used within their validity period will be cancelled. Invitation Vouchers are not redeemable for cash, cannot be transferred to any other member and cannot be used in conjunction with any other special promotion or Discount Voucher.

You can invite your friends by typing their email address in the top right corner under "Invite a friend" and clicking on ‘Send’. Alternatively, you can select the “Invite a Friend” banner, enter your friends email addresses and select ‘Submit’. We will send an initial e-mail to your friend advising them that you have invited them to become a member of our Website, but we will not send your friend any further e-mails without their consent.

To ensure that your referral is a Valid Referral and you are entitled to the Invitation Voucher:

1. You can only refer people you know personally. Mass referrals via a website or email list are strictly prohibited. Please make sure you obtain your friend’s consent before providing us with their details and we may tell your friend who introduced them. As part of our referral process we may request your friend to confirm that they know you.

2. Your friend and the email address provided must not already be registered with us.

3. Your friend will be required to make orders from our Website using the email address provided by you.

4. Please remember that your Invitation Voucher will be sent to you at the time the goods ordered by your friend are order is shipped out for delivery. We reserve the right to cancel Invitation Vouchers where orders are cancelled.

We reserve the right not to issue an Invitation Voucher and/or terminate your membership where we have reasonable grounds to suspect that there is an abuse of the friend referral scheme. Any abuse of the friend referral scheme may be stopped by Fashionation.me with immediate effect by cancelling all vouchers (including Invitation Vouchers and other vouchers issued to you by Fashionation.me) that have been issued but not used, cancel any outstanding orders and terminate your membership. We also reserve the right to refuse orders or to issue Invitation Vouchers to members that have, in the past, abused the scheme in some way.

Orders

All sales are limited in terms of time and stock and all orders are subject to availability. Orders will not be accepted or processed after the sale period has expired. All items are sold on first come first served basis, although certain membership types may be entitled to preview sales. All orders must be placed through the Website. We are unable to process any manual payments or orders. Items ordered are not available for re-sale.

To place an order, members must select the required item(s) and add it to their shopping basket by clicking on the 'Add to Basket' link. You can review the selected item(s) at any time by clicking on the 'My Basket' link and continue shopping by clicking on the 'Continue Shopping' button. Once you have completed your shopping, please click the ‘Checkout' button.

Items will only be held in your basket for 15 minutes before you will receive a reminder message and an additional 5 minutes for you to proceed to the checkout. If you have not proceeded to the checkout and placed your order after 20 minutes, the goods in your basket will be released back into the available stock. Your basket will be automatically emptied but you can recommence the buying process at any time.

Any literature published or submitted on our Website which contains any descriptions, specifications, drawings or prices of the goods or services is published or submitted for guidance only. We reserve the right to make changes or correct errors (including errors in pricing, design and specification of the goods) at any time without notice to you. Where you have made a purchase and there was an error on our Website, we will notify you of that error and the necessary changes to your order. If you do not wish to proceed with your order after notification of the error, we will simply cancel the order and refund any money paid.

To confirm your order, you must confirm your delivery address as well as other details of the order including the item(s) ordered, quantity, price, total and other such details as are required to process your order. It is your responsibility to ensure the details of your order is correct. We will not be liable for any errors, mistakes or delivery failures arising as a result of incorrect details. Please notify us as soon as possible if any of the details submitted are incorrect as failure to do so may result in non-delivery of any ordered items. Please note that once your order shows ‘In Progress”, ”In Transit” or “Immediate Dispatch”, no amendments or changes can be made to the delivery address details. You do not have the ability to modify or cancel an order once you have confirmed it by clicking “YES, I confirm my Order”. Each order shall constitute a separate transaction and we are not able to consolidate separate transactions into a single order or delivery. If you would like to order multiple items please ensure that all items appear on the order form before you confirm your order. Unfortunately, we are not able to consolidate delivery charges for more than one order placed.

The prices displayed on our Website are expressed in United States Dollars. You can choose to view the prices in your preferred currency however these prices will be a guide only. The actual currency conversion of our price to your ‘billing’ currency will takes place at the point of payment. You will be provided with full disclosure of the conversion rates at the time of payment.

Not all items will be available for sale and delivery to all countries. The countries approved for delivery are stated in the country list under My Account / Billing and Address Delivery. If special restrictions apply to certain sales events, this will be clearly stated.

All orders are subject to acceptance and availability. We will confirm acceptance of your order by email. We recommend you retain the email or print out the confirmation of your order. When the total stock available for sale of an item reaches 5 pieces, we will start to indicate the number of remaining items on the ‘Brand Page’. This number reflects the total inventory of the item available, not the quantities per size. The quantity per size is available on the ‘Product Page’ by running your mouse over the different sizes in the ‘Select your size’ section. In the event of an unavailable item, the particular item will be cancelled from your order and a full refund will be made including any applicable delivery charges. Where your order includes multiple items, the remainder of the order will remain valid (including the delivery charges). Notification will be sent to you via an Email to the address provided at registration, confirming that your order for the item has been cancelled and your refund has been processed. It will take a minimum of 5 days from receipt of such Email for the refunds to appear in your bank account.

Delivery

We will provide you with expected shipping and delivery dates. These shipping and delivery dates are estimates only and we will not be liable for late delivery of your order. Due to the nature of our stock, we may have to wait to receive items from our suppliers, consequently whilst we would use our best endeavours to dispatch items within the indicated delivery times, orders may sometimes take longer than indicated. We will advise you of any delays in the delivery time, where possible. Items will be delivered to the registered delivery address. You are responsible for providing full and complete delivery address details. We are not able to deliver to PO Boxes. Please note that once your order shows ’In Progress’, ’In Transit’ or ’Immediate Delivery’, no amendments or changes can be made to the delivery address details. When your order is shipped, you will receive an email specifying the tracking number of the parcel. You can use this number to track your parcel on the Website of the designated courier company.

Failed delivery

If member is not present at the time of delivery, a note will be left inviting to contact the courier directly in order to arrange a new delivery at a convenient time. We are unable to re-send parcels that are returned to us as undeliverable, unless additional delivery charges are paid. If after 10 days following notification of the tracking number you have not received the parcel or a delivery note, you must contact our Customer Service either by phone or email. If the parcel is found, it will be sent immediately. In the event that the parcel has been lost, we will refund the total amount including delivery costs. In the event of failed delivery of any order, we will not be liable for any additional charges incurred by you for further delivery attempts.

Delivery non-conformity

We are careful in preparing our orders for delivery and recommend that when you receive your order, you carefully check the item(s) received. If for some reason there is an error in your order, please notify our Customer Service team by phone, email or using our Website as soon as possible in accordance with the Returns policy section of these terms and conditions. If the delivery box/packaging is damaged, please ensure that you note this in writing on the proof of delivery sheet.

Due to the nature of the goods supplied by us we are normally unable to provide replacements for incorrect or defective goods or undertake repairs. Subject to a full investigation by us with our supplier, should your item be found to be defective, we will provide a full refund including any reasonable delivery costs in returning the defective or incorrect item. Please note that delivery costs attaching to the original order will only be refunded where the full order has been found to be defective. We will complete our investigation as soon as possible, however advise that the investigation period will vary according to the goods or services ordered and the supplier involved. We will give you an indication of the estimated investigation period at commencement of the process.

Returns policy

We accept returns on footwear and clothing (excluding lingerie and underwear, socks, swimwear) items for store credit, provided they have not been used and you follow our returns procedure. Unfortunately we cannot accept returns or give refunds for bags, fragrances, cosmetics, watches, jewellery, accessories, leather goods, wallets, luggage, sunglasses, lingerie and underwear, socks, swimwear and home decoration. These items are Final Sale only.

When you receive your order, you have 5 days after delivery to let us know if you wish to return an item. You must return the item to us in its original condition of delivery and in its original packaging, including items such as hangers, wrapping, hang tags, shoeboxes and dust bags. We reserve the right to refuse to refund any item which has been used or has been worn, is returned incomplete, has been visibly damaged after delivery, or has not been returned to Fashionation.me in complete compliance with our return procedure.

To return an item, log on to the Website and follow the procedure under the link ‘Return an Order’ and complete a Return Authorisation form and click ‘Submit’. You must submit this form within 5 days of receiving your order. Our Customer Service team will review your request and revert to you by email with a Return Approval Code within 3 working days. Our Customer Service team will provide you with the contact details of our logistic supplier in your country for you to organise a pick-up time. It is your responsibility to ensure a copy of the Return Authorisation Form and the Return Approval Code is enclosed with the parcel for ease of identification. Should you fail to enclose the Return Approval Form, we may not be able to refund the items until we are able to identify the related order. Each return parcel must relate only to one order. You must not mix orders in returned parcels. Return parcels that contain mixed orders will result in only ONE order being refunded. When you return an item to Fashionation.me, we will credit your account for the amount of the returned item less the initial delivery costs. Your credit can then be used towards your next purchase with us. Please note that, if you decided to return items because they do not fit or you simply changed your mind, we may ask you to pay the shipping expenses related to the return. Should you fail to return the goods to the return address provided, use the parcel company indicated by us to ensure the proper return of the parcel, we shall not be held responsible for any delays in granting store credit and may deduct any additional costs incurred in locating the parcel from the store credit to be granted.

In the unlikely event you receive an item that is either faulty, damaged or does not correspond to your order, we will accept returns whether the item would ordinarily be refundable or not. In such circumstances, please follow the procedure under the link ‘Return an Order’ and complete a Return Authorisation Form. Alternatively, you may contact our Customer Service team by email or phone (Contact us) with the information relating to your order. We will do our best to resolve the issue as quickly as possible. Refunds related to products that are faulty, damaged or do not correspond to your order are made to the original card or payment source. The card or account details are not able to be changed or amended for audit and fraud purposes. Should a refund be rejected for any reason, by either our bank or your bank, Customer Service will contact you to discuss alternative methods/options for your refund.

Exchanges

Although we will always try to do the utmost to please you, the nature of our business makes it impossible for us to guarantee that we will be able to exchange an item that you purchased. If we cannot exchange the item, you may request to return the item by following our returns policy procedure provided the item is footwear and clothing (excluding lingerie and underwear, socks, swimwear).

Pricing & Payment

All items are priced in United States Dollars. You can choose to view the prices in your preferred currency however these prices will be a guide only. This preferred currency can be changed by you at any time in My Account / Personal Details. The actual currency conversion of our price to your preferred billing currency will take place at the point of payment. We reserve the right to define the exchange rates between the various currencies. The prices quoted are exclusive of delivery charges and applicable taxes (such as import taxes and VAT) which will be indicated to you during the ordering process. We reserve the right to modify our prices at any time but the items will be charged at the rate which was current at the time the order was placed (subject to any errors or mistakes).

The recommended retail price quoted in the description of an item is the price provided by our supplier as the full selling price of the item when the item was originally in the supplier's distribution network. This price is provided for comparison purposes only. The discount savings mentioned in our website are based on this recommended retail price.

Once you have reviewed your order and provided the required personal details, you will be required to click on “Confirm order” to pay by credit card or Paypal. Payments will be processed through a secure payment service provided by our payment processing partner DataCash PLC. DataCash are fully compliant with the Payment Card Industry Data Security Standard (“PCI DSS”) and have been for the past five years. Whilst we have taken care in selecting our payment processing partner, Fashionation.me shall not, to the fullest extent permitted by law, be liable for their operating practices and we recommend you contact them with any questions or queries or review their practices and privacy statement available on their website http://www.datacash.com/about/privacy.php. At no time will the member’s payment details be transferred or stored through the Fashionation.me electronic system. Payment will be deducted within 5 days of an order being accepted.

Discount Vouchers

You may occasionally receive Discount Vouchers (including Invitation Vouchers) (“Discount Vouchers”) from us, via e-mail or through promotional materials. Each voucher is personal to the member receiving it, is not transferable, has no monetary value and under no circumstances can it be converted into cash or currency. Discount Vouchers cannot be used in conjunction with any other special promotion unless permitted or combined with other Discount Vouchers. Only one Discount Voucher may be used per order. Each voucher has an expiry date (maximum 12 months) which cannot be extended. Vouchers not used within their validity period will be cancelled. The expiry dates for your vouchers can be found on your Fashionation.me account.

Discount vouchers cannot be split into smaller values and any remaining amount left on a discount code after a purchase cannot be retained or used in another transaction. Accordingly, the full use of a Discount Voucher requires the total value of the order (excluding delivery costs) to be equal to or higher than the monetary value of the discount given by the voucher. Some Discount Vouchers may specify a minimum spend in order to be used. In this case, the monetary value of the order (excluding delivery costs) has to be equal to or higher than the minimum spend.

Under no circumstances can a Discount Voucher be used if the Discount Voucher is defective or expired.

To use a Discount Voucher, you must click on the link ‘Use a Voucher’ and:

 Select the discount voucher you wish to use. After selecting the Discount Voucher, click on the 'Redeem' button

 When an order is placed using a Discount Voucher and your order contains a number of items, the value of the discount is shared across each item unless the Discount Voucher relates solely to a particular item. Any refund of an item bought in such an order will be for the amount actually paid after application of the discount.

Access to the Website and content

We are continually reviewing the items available on the Website, so specifications or design changes may be made at any time. We shall use reasonable commercial endeavours to keep the Website up to date but information and specifications given are for your information only and are subject to change without notice. We try to ensure that pictures of the items on the Website are as accurate as possible, but there are technical limitations and slight variations in colour and texture between the pictures and the items themselves must be expected. We will endeavour to allow uninterrupted access to the Website, but access may be suspended, restricted or terminated at any time. The Website may include links to other websites or material, which are beyond its control. We are not responsible for access to and content on the Internet, or any site other than the Website.

Manufacturers Guarantee

The item description on the Website may specify if the item is subject to a manufacturer’s guarantee and the item will be accompanied with such guarantee on delivery. If you have a defective item covered by an applicable and valid manufacturers guarantee, you must contact our Customer Service team. Our Customer Service team may ask you to contact the supplier directly and we will do our best to provide you with the contact details of the after-sale service of the supplier.

Liability

To the fullest extent permitted by law, the functions contained in this site, the operations of this site and all content on this site are provided “as is”, without warranty of any kind, either express or implied, including, but not limited to, any implied warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement. To the fullest extent permitted by law Maffeo Services Ltd and its affiliates, directors, officers and employees shall not be liable for any damages whatsoever (including, without limitation, incidental and consequential damages, loss of profits) resulting from the use or inability to use the Website and the materials available on the Website unless such damages are the result of fraud or gross negligence on the part of Maffeo Services Ltd. Whilst we will take all reasonable care to keep your order details secure, to the fullest extent permitted by law, we disclaim all liability for any loss you may suffer if a third party obtains unauthorised access to any data (including credit and account details) you provide when accessing or ordering from the Website.

Matters outside our control

We shall not be liable to you or in breach of these terms and conditions for a delay or failure to perform if the delay or failure is due to a cause beyond our reasonable control (“Event”). We will contact you within five (5) days of the Event in order to discuss possible alternatives for the performance of the relevant obligation. If the Event lasts for more than thirty (30) days, your order will be deemed to be cancelled and you will receive a full refund.

Exceptional circumstances

In exceptional circumstances, we reserve the right to end any agreement with you, cancel or place on hold any orders, suspend or terminate your access to the Website immediately and without notice to you and/or and refuse any and all current or future use of our Website if information provided by you is untrue, inaccurate, not current or incomplete, you breach any of the these terms and conditions, you fail to make any payment when due, we suspect you are about to engage in or have engaged in fraudulent or illegal activity on the Website or have if requested to by us, failed to provide us with sufficient information to enable us to verify the accuracy and validity of any information provided to us so as to prevent fraudulent use of the Website. If required as determined by our sole discretion, you may be requested to send us proof of ID (e.g. copy of passport) as well as proof of your address for the past 3 months. In such circumstances any orders will only be dispatched after we have received and verified these documents. We are unable to reinstate any orders cancelled in such circumstances.

Intellectual property

The copyright in the material contained in the Website, together with the Website design, text and graphics and their selection and arrangement and all software compilations, underlying source code and software (including applets) belongs to us or the providers of such information who license us to use it. All rights are reserved. You may not reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Website without written permission from us. You may retrieve and display the content of the Website on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices.

General

If any provision of these terms and conditions is held to be unlawful, invalid or unenforceable, that provision shall be deemed severed and the validity and enforceability of the remaining provisions of these terms and conditions shall not be affected. You may not assign, sub-license, or otherwise transfer your membership or any of your rights under these Terms and Conditions. If we fail to enforce a right under this Agreement, that failure will not prevent us from enforcing other rights or the same type of right on a later occasion.

Governing law

These Terms and Conditions shall be governed by the Cypryot laws. You and we agree to submit to the exclusive jurisdiction of the courts of Nicosia, Cyprus.

Language

These terms and conditions are available in English and Arabic. In the event of any inconsistency between the two, the English language version shall prevail to extent of such inconsistency.
